REFRA WARRANTY TERMS AND CONDITIONS

These Warranty Terms and Conditions shall apply to products (hereinafter the Product) manufactured by UAB Refra (hereinafter the Manufacturer), to the extent they are not in conflict with the terms and conditions of the relevant agreement of purchase of a particular Product entered into by the Manufacturer and the person who acquired the Product from the Manufacturer (hereinafter the First Purchaser). The provisions contained in the agreement entered into by the First Purchaser and the Manufacturer shall supersede these Warranty Terms and Conditions.

Where the end user purchases the Product from the First Purchaser rather than directly from the Manufacturer, the warranty shall apply to the end user only to the extent and subject to the terms and conditions that were granted by the Manufacturer to the First Purchaser. The Manufacturer shall not be liable for any additional or extended warranties provided by the First Purchaser to the end user; any such obligations shall be the exclusive liability of the First Purchaser.

The warranty period normally applicable to the Product and parts thereof is indicated in the Product purchase agreement. Where the Product purchase agreement entered into with the First Purchaser does not specify a warranty period applicable to the Product, a 12-month warranty period shall be granted commencing from the start of operation of the Product as confirmed by the statement of putting into operation, but in any case the warranty shall remain valid for no more than 18 months from the moment of handover of the Product to the First Purchaser or its carrier.

 

The warranty shall not cover any of the following:

  • Any naturally wearing/consumable parts and units of the Product or any parts that must be periodically replaced, e.g. light bulbs, fuses, small plastic parts such as handles, etc.;
  • Any Products or parts thereof that the First Purchaser or the end user fail to provide to the Manufacturer for assessment;
  • Any software (software shall be subject to the warranty terms and conditions stipulated by the respective software manufacturer);
  • Any Product malfunctions that may have arisen due to control systems or their parameters, in cases where a controller and/or control platform other than those indicated by the Manufacturer are used to control the Product. In this case, the warranty shall apply only to structural or workmanship defects.

 

Warranty shall not apply in any instances where:

  • The Product was operated in violation of the Product operation manual supplied together with the Product and/or available in the account of the First Purchaser on the website of the Manufacturer and/or in violation of the terms and conditions stipulated in the Product purchase agreement;
  • The Product was used for any purposes other than its intended purpose, or under inappropriate conditions;
  • The malfunction of the Product resulted from the inappropriate transportation of the Product;
  • Mechanical, thermal, chemical or other damage was caused to the Product, which may have resulted in the malfunction of the Product;
  • The malfunction appears due to the inappropriate assembly or installation of the Product performed by a person other than the Manufacturer;
  • The malfunction was caused by foreign items, materials, or liquids inside the Product;
  • The malfunction appeared due to force majeure events (e.g. lightning, flood, etc.), power outages and/or fluctuations;
  • The malfunction appeared as a result of the end user and/or the First Purchaser using inappropriate naturally wearing/consumable parts in the Products;
  • The Product was disassembled and/or repaired by a person other than the Manufacturer without the consent from the Manufacturer;
  • The malfunction appeared due to the failure to carry out preventive maintenance work, where such work is mandatory;
  • The Manufacturer is contacted after the expiration of the warranty period.

 

Please note that:

  • During the warranty period, the Manufacturer undertakes to replace or repair the Product or parts thereof within a reasonable time limit where they do not function properly or do not meet the quality requirements stipulated in the agreement; the duration of the Product repair or replacement time limit depends on the availability and delivery terms of spare parts and is normally 2 to 3 weeks for standard Products and may be longer for customised Products. The time limits provided above are for reference only, and the Manufacturer hereby does not undertake to replace or repair the Product within the time limits provided above;
  • Any Products or parts thereof that malfunction during the warranty period shall be, at the sole discretion of the Manufacturer, repaired or replaced;
  • In cases where the warranty does not apply, the Manufacturer shall charge for the repair of the Product and/or parts thereof, spare parts and materials;
  • Any faulty/inappropriate parts removed from the Product during warranty repair shall be retained by the Manufacturer;
  • Any repaired or replaced Product and parts thereof shall be subject only to the remaining original warranty period; the warranty shall not be extended either during the repair or the replacement period;
  • The warranty shall cover only the repair or replacement of the Product or parts thereof, and the Manufacturer shall not bear any Product repair or part replacement expenses where such repair or replacement is carried out by a person other than the Manufacturer, any losses or damage (including direct and consequential losses), and any expenses relating to the dismounting, transportation, loading, unloading, packaging, repeat assembly or putting into operation of the Product or any related other costs and labour expenses shall not be reimbursed, except in cases where provided otherwise in imperative legislation or the Product purchase agreement entered into with the Manufacturer;
  • The First Purchaser and/or the end user shall deliver the malfunctioning Products and/or parts thereof to the Manufacturer by their own means and at their own expense;
  • The malfunctioning Products and parts thereof must be delivered to the Manufacturer of the condition at the time of the malfunction, i.e. assembled and unrepaired;
  • Malfunctioning compressors must be delivered to the Manufacturer with the oil filling that was available at the time the malfunction occurred. Compressor outlets must be plugged.

 

In case of malfunctioning of the Product:

  • The First Purchaser must notify the Manufacturer about the malfunctioning of the Product immediately, but in any case within 5 business days from the identification of the malfunction or from notification of the malfunction by the end user (and in any case within 10 business days from the identification of the malfunction);
  • The end user shall notify any malfunction of the Product to the First Purchaser from whom it purchased the Product. The end user may directly contact the Manufacturer only if the First Purchaser has discontinued its operations;
  • The First Purchaser must complete the Claim form and the Commissioning Act available on the Manufacturer’s website at refra.eu;
  • The notification accompanied by the supporting evidence (photos and/or video materials documenting the malfunction or the issue) shall be e-mailed to the Manufacturer to [email protected];
  • Upon receipt of the notification, the Manufacturer shall register, store and process it in accordance with the procedures of UAB Refra quality management system compliant with the requirements of ISO 9001:2015/LST EN ISO 9001:2015 (certified by UAB Bureau Veritas Lit, certificate No.: LT2033Q) and, within 2 business days from the receipt of the notification by e-mail, provide the First Purchaser or the end user with the number assigned to the claim, which number must be indicated in any subsequent communications with the Manufacturer;
  • The Manufacturer shall examine the information contained in the notification within 10 (ten) business days from the receipt of all relevant information, and shall remain in contact with the First Purchaser and/or the end user;
  • Where the Manufacturer adopts the decision that the warranty does not apply, a substantiated explanation of as to why the warranty does not apply shall be provided.
